They can. If the nursing home violated the standard of care that is appropriate under those circumstances.

Chapter 400 in Florida statutes provides a nursing home residents “bill of rights.” It is an extensive listing of the rights that a nursing home patient has. If that nursing home violates those standards — violates those patients’ rights and harm comes to that patient, then yes — a nursing home can be held responsible for what happens to the patient.
