Do most patients realize that medical malpractice has occurred?

When people call us, they think malpractice might’ve occurred because of a bad outcome. A bad outcome doesn’t mean medical malpractice. But medical malpractice can produce a bad outcome.

Do patients realize when medical malpractice has happened? Maybe. When we are contacted and evaluate the case, we need to look at the medical records and try to understand precisely what happened. And in understanding what happened, we see that the outcome was bad. That a person has suffered injuries as a result of it. We can then advise the patient or the client that medical malpractice has likely occurred – or not. And we can pursue the case by having it evaluated further.
