Can I sue the Bar that served the Drunk Driver?

These are called Dram Shop cases in Florida. Florida’s Dram Shop statute is really rather protective of the liquor industry.

In Florida, there are only two instances where a person can make a claim against the business (a bar or tavern) who served the alcohol. Those two instances are this:

1) if the business sells to a person who is under age and the business knows or should have known that the person is underage.

2) if the business serves a person who is habitually addicted to intoxicating liquors.

In those two instances, if the business serves to one of those people, knowingly, then you may be able to make a claim against the business who serves the alcohol.
