Prove to Win

You must show that the physician or the healthcare provider breached the standard of care. What does that mean? It means that they failed to do what a reasonable physician with similar circumstances, training and experience would do under the circumstances of that case. It’s called a breach of the standard of care.

It’s really negligence. It’s failure to use reasonable care, but in a healthcare setting. It’s failure to use the kind of care that a competent physician or healthcare provider would have done under those same circumstances.
